Chapter III: Measures to be taken during operations

Section 1: Inspections and periodic coordination meetings

Article R4513-1

During operations, each company implements the measures set out in the prevention plan.

The head of the user company checks with the heads of external companies to ensure that the measures decided upon have been implemented. He coordinates any new measures to be taken during the course of the work.

Article R4513-2

The head of the user company shall organize, together with the heads of any outside companies he deems it useful to invite, periodic inspections and meetings, at intervals he shall define, in order to ensure, depending on the risks or when circumstances so require :

1° Either general coordination within the user company premises

2° or the coordination of preventive measures for a given operation

3° or the coordination of measures made necessary by the risks associated with interference between two or more operations

Article R4513-3

The heads of the companies involved in the operations in question are informed of the dates of inspections and periodic coordination meetings.

When they deem it necessary in view of the risks involved, the managers of external companies who are not invited to attend meetings and inspections organized by the user company, at their request.

In the absence of a meeting or inspection, the heads of external companies may, if they consider it necessary for the safety of workers, ask the head of the user company to organize such meetings or inspections.

Article R4513-4

Measures taken during the coordination process are updated in the prevention plan.

Article R4513-5

When all the operations of external companies present on the site lead to the employment of workers for a total of more than 90,000 hours over the next twelve months, inspections and periodic coordination meetings are held at least every three months.

These provisions apply even when the second and third paragraphs of article R. 4513-3 are applied.

Article R4513-6

When new workers are assigned to carry out the work during the operation, the head of the external company informs the head of the user company.

The head of the user company is obliged to provide these workers with the information specified in Article R. 4512-15.

Article R4513-7

The head of the user company checks with the heads of external companies that they have given workers instructions appropriate to the risks associated with the presence of several companies on his site.

Section 2: Premises and facilities used by contractors

Article R4513-8

Sanitary facilities, collective changing rooms and catering facilities are made available by the user company to external companies present on the site, unless the latter provide equivalent facilities.

Additional installations are set up, if necessary, on the basis of the average number of workers from external companies who are expected to be employed on a regular basis in the user company's establishment over the coming year.

Section 3: Medical surveillance

Article R4513-9

Where it is compulsory to draw up a written prevention plan, in accordance with Article R. 4512-7, this plan is made available to the occupational physician of the user company and to the occupational physicians of the external companies concerned.

They are informed of any updates.

The prevention plan and its updates are sent to them on request.

Article R4513-10

The occupational physician of the external company provides the occupational physician of the user company, at the latter's request, with the necessary information from the individual medical file of the external company's workers.

The occupational physician of the user company provides the occupational physician of the external company, at the latter's request, with information on the particular risks that the work presents for the health of the external company's workers concerned.

Article R4513-11

The occupational physician of the user company carries out, on behalf of the external company, any additional examinations made necessary by the nature and duration of the work carried out by the external company worker in the user company.

The results are communicated to the company's occupational physician, notably with a view to determining the employee's medical aptitude.

Article R4513-12

By agreement between the heads of the user company and the external company and the occupational physicians concerned, the periodic examination provided for in articles R. 4624-16 et seq. and, for agricultural employees, in article R. 717-15 of the French Rural Code, may be carried out by the occupational physician of the user company on behalf of the external company.

The user company's occupational physician communicates the results to the external company's physician, in particular with a view to determining medical fitness.

Article R4513-13

The conditions under which the external company's occupational physician has access to the workstations occupied or likely to be occupied by the external company's workers are agreed between the user company and the external company, after consultation with the occupational physicians concerned.
