Section 1: Common provisions
Article R4514-1
The health, safety and working conditions committees of the user and contractor companies are informed:
1° Of the date of the joint preliminary inspection by the heads of the companies concerned, as soon as they are aware of it and no later than three days before it takes place. In the event of an emergency, they will be informed immediately.
2° Of the date of inspections and periodic coordination meetings, no later than three days before they take place. In the event of an emergency, they are informed immediately of
3° Any of the urgent and serious situations mentioned in 3° of article L. 4614-6.
Article R4514-2
When it is mandatory to draw up a written prevention plan, in application of article R. 4512-7, this plan is made available to the user company's health, safety and working conditions committee and to those of external companies.
These committees are informed of any updates.
This plan and its updates are made available to them on request.
They receive all the information they need to carry out their duties.
Article R4514-3
The competent user company's health, safety and working conditions committee shall, if it deems it necessary, appoint one or more of its members of the staff delegation to take part in the prior joint inspection.
If they deem it necessary, the health, safety and working conditions committees of the external companies concerned take part in the prior joint inspection, in accordance with the conditions laid down in Article R. 4514-9.
Committee members designated to take part in the joint preliminary inspection issue an opinion on prevention measures. If the plan is to be drawn up in writing, this opinion is recorded on the prevention plan.
Article R4514-4
Inspections and periodic coordination meetings are organized at the request of two employee representatives on the user company's health, safety and working conditions committee.
At the reasoned request of two employee representatives on the health, safety and working conditions committee of the external company, the provisions of the second and third paragraphs of article R. 4513-3 are implemented by the head of the external company.
Article R4514-5
The following notices are posted at the entry and exit points of the user company's personnel:
1° The names and places of work of the members of the health, safety and working conditions committee of the user company and of external companies.
2° The name of the user company's occupational physician
3° The location of the user company's infirmary
Section 2: User company health, safety and working conditions committee
Article R4514-6
The user company's health, safety and working conditions committee may, if it considers it necessary, appoint one or more of its members of the staff delegation to take part in inspections and periodic coordination meetings.
These members issue an opinion on prevention measures. This opinion is recorded on the prevention plan when the plan has to be drawn up in writing.
Article R4514-7
Where there may be risks associated with interference between the activities, facilities and equipment of different companies, the user company's health, safety and working conditions committee carries out, as part of its duties, the inspections and surveys provided for in Articles L. 4612-4 and L. 4612-5, in workplaces temporarily occupied by workers from outside companies.
Section 3: External company health, safety and working conditions committee
Article R4514-8
The health, safety and working conditions committee of the subcontractor, if it deems it necessary, instructs one or more of its members belonging to the staff delegation to take part in inspections and periodic coordination meetings, when the subcontractor is scheduled to take part.
These members issue an opinion on prevention measures. This opinion is recorded on the prevention plan when the plan has to be drawn up in writing.
Article R4514-9
Before work begins, when a staff representative on the health, safety and working conditions committee is to be part of the team working in the user company, and the committee intends to take part in the prior joint inspection, in application of the second paragraph of article R. 4514-3, this staff representative is designated to take part in this inspection.
If this is not the case, the committee may appoint an elected employee representative holding another mandate, if he or she is to be assigned to the user company.
Article R4514-10
The provisions of article R. 4514-9 apply during the performance of work when the health, safety and working conditions committee of the external company intends to apply the first paragraph of article R. 4514-8.
